As the breach was admitted we find the charge proved.

Accordingly, after taking all the above into account and under the provisions of rule 1106(2) we impose a suspension on Miss Johnson from riding in races which is to start after racing on 10 March and conclude after racing on 15 March 2012 (5 days).

Facts:
Following race 4 an information was filed pursuant to rule 638(1) (d). The informant, Mr C George alleged that near the 300 metres Miss D Johnson allowed her mount TOUCHDOWN to shift out when not sufficiently clear of CLASSCOROC (Mr N Harris) which was checked.
Submissions for Decision:
Mr Oatham demonstrated the video films which clearly showed Miss D Johnson angling her mount TOUCHDOWN out for clear running at the 300 metres. In doing so, she moved into the line of CLASSCOROC which had to be checked for a number of strides. Mr Oatham submitted Miss Johnson was never the required distance clear in that outward movement.
Miss Johnson in admitting the breach said her mount was going well at the time and when a gap presented itself she went for it. She added the check to Mr Harris was a relatively minor one.

Mr George said Miss Johnson had incurred four suspensions in the last 12 months. He submitted her carelessness on this occasion was midrange.
Miss Johnson told the committee she had commitments up to and including 10 March and she regularly rode throughout the country.
Reasons for Penalty:
The committee carefully considered all evidence and submissions. The only mitigating factor in this charge is Miss Johnson's admission of the breach. Because only one horse was affected and the check to Mr Harris was not a severe one we find her carelessness to be in the low to midrange. As this is her 5th charge in the last 12 months her record can only be described as fair. The committee acknowledges that Miss Johnson rides throughout the country.
