Decision:

Following Race 9 an Information was filed pursuant to Rule 871 (1) (d).  The Informant Mr R Sanders alleged that Mr J Jago permitted his mount HEAD ON HIGH to shift in, taking PAY BACK (D Johnson) inwards crowding THE GROGOCH (V Colgan) which had to be checked.



Following Race 9 an Information was filed pursuant to Rule 871 (1) (d).  The Informant Mr R Sanders alleged that Mr J Jago permitted his mount HEAD ON HIGH to shift in, taking PAY BACK (D Johnson) inwards crowding THE GROGOCH (V Colgan) which had to be checked.

This occurred at the 1800 metres.

Mt Jago did not admit the breach.

--

Mr Oatham demonstrated the video films which showed HEAD ON HIGH racing 5 off the rail and racing keenly when approaching the 1800 metre mark.  He showed Mr Jago then shifted in to a position 3 off the rail and in doing so take the line of PAY BACK (D Johnson) when not the required distance clear.  This movement forced Ms Johnson in, crowding THE GROGOCH causing V Colgan to check.

Mr Jago in his statement said in his opinion Mr Colgan had taken hold of his mount prior to the incident and he believed he had not put any pressure on Ms Johnson to cause this.  He said in his opinion he was clear of Ms Johnson when moving in.

Mr R Sanders said it was very clear on the videos that Mr Jago was only ¾ - 1 length clear of Ms Johnson and moved from 5 wide to 3 wide causing checks to 2 horses.

DECISION

The Committee carefully considered all evidence and reviewed the video films.  We are clearly of the opinion that Mr Jago was not the required distance clear of Ms Johnson when moving in from a 5 wide position to one of 3 wide.  We are satisfied that the only reason Mr Colgan had to check was receiving pressure from Ms Johnson which was caused by Mr Jago.

Accordingly we find the charge proven.

PENALTY SUBMISSIONS

Mr Jago said he had a ride in the Oaks on 14 March 09 and only rode in the north and central districts.

Mr Sanders said Mr Jago had 2 previous suspensions in the last 9 months.  He reminded the Committee 2 horses had been checked and it was a $40,000 race on a premier day.  He submitted a 6 – 8 day suspension was warranted.

PENALTY

The Committee considered all submissions and before imposing an appropriate penalty took into account the following:

-  Mr Jago’s racing record

--

-  His level of carelessness which we believe was mid range.

--

-  The checks to 2 horses

--

-  This was a premier day and the race was for a $40,000 stake

--

 

--

Accordingly we impose a suspension to start after racing on 14th March and conclude after racing on 26 March 2009  (6 days).
