Decision: Following Race 5, an information was filed by the informant Stipendiary Steward Mr A Coles pursuant to Rule 871 (1) (d). He alleged that Mr I Lupton, rider of RAVANELLI, permitted his mount to shift outwards near the 600 metres when not sufficiently clear,
Following Race 5, an information was filed by the informant Stipendiary Steward Mr A Coles pursuant to Rule 871 (1) (d). He alleged that Mr I Lupton, rider of RAVANELLI, permitted his mount to shift outwards near the 600 metres when not sufficiently clear, hampering MARIO, ridden by C Parish, and causing a sharp check to GOLDEN CRUSADER, ridden by J Lewis.
--Mr Lupton admitted the breach.
--Stipendiary Steward Mr Oatham demonstrated the video films and showed that near the 600 metre mark RAVANELLI, ridden by Mr Lipton, moved out when insufficiently clear and into the line of the favourite MARIO, ridden by C Parish, who had to be eased. RAVANELLI then moved further out which caused a sharp check to GOLDEN CRUSADER, ridden by J Lewis, who lost considerable ground as a result.
--Mr Lupton, in admitting the charge, had nothing to say when asked.
--Mr Coles produced Mr Lupton’s record which showed only 1 charge in the last 12 months – an excellent record. However, he asked the Committee to consider the status of the race and the sharp check received by GOLDEN CRUSADER. He submitted a 5 – 7 day suspension would be appropriate.

PENALTY
--The Committee considered all submissions and before imposing a penalty took into account the following :
--1. Mr Lupton’s guilty plea.
--2. His excellent riding record.
--3. The status of the race.
--4. The level of interference caused by Mr Lupton.
--Accordingly, we impose a 3 week suspension, to start immediately and conclude after racing on 28 September 2008 (6 days).
