Penalty:
The Committee grants a deferment to Mr Riddell’s suspension pursuant to Rule 1106(2).
Accordingly, Mr Riddell had his license to ride in races suspended for a period to commence after racing on 11 November and conclude after racing on 28 November 2018.
Facts:
Following the running of race 8, Carbine Club Trophy, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Oatham, alleged that Mr Riddell allowed his mount DEALS IN HEELS to shift in (over the concluding stages) when insufficiently clear of ROCKABYEBABY which was forced inwards clipping a heel of ALL ROADS and blundering.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Riddell said he understood the Rule and confirmed that he admitted the breach.
Mr Coles demonstrated the incident using the available video footage. He identified over the concluding stages of the race that Mr Riddell was looking to take a run to the outside of MONGOLIAN MARSHAL when that runner shifted out. He said that MONGOLIAN MARSHAL was clear of other runners when it shifted out. At that point Mr Riddell switched his mount for a run to the inside of MONGOLIAN MARSHAL. He said in doing so Mr Riddell crowded and checked ROCKABYEBABY which was forced inwards clipping a heel and blundered badly. He said that when ROCKABYEBABY was forced in SEVENTEEN SEVENTY also clipped a heel and blundered badly.
Mr Riddell said there were a few factors as to why he shifted in over the concluding stages of the race. He said that MONGOLIAN MARSHAL was shifting ground and he elected to shift to that runner's inside. He said the interference happened on the finish line and he had sat up when crossing the line. He said he thought he was clear of ROCKABYEBABY near the finish line and his inward manoeuvre resulted in a chain reaction to runners on his inside.
Submissions for Penalty:
Mr Oatham produced Mr Riddell’s record which showed 9 previous breaches under this Rule in the last 12 months. He said Mr Riddell’s record was rather poor and described the level of carelessness as high end. He said that Mr Riddell directed his mount in quite abruptly over the final stages of the race and he was lucky that no horses fell during the incident. He said the JCA Penalty Guide starting point for high range carelessness is 10 days and the Committee had to consider the aggravating factors in this breach.
Mr Riddell advised that he had engagements up to and including 11 November and sought a deferment to fulfil those engagements. Mr Riddell accepted that his record is poor and he was forthright in that “he needs to deal with it”.
The Committee advised Mr Riddell that the JCA Penalty Guide starting point for careless riding causing a fall is a 4 week suspension. Mr Riddell acknowledged this fact.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented.
When reviewing the video footage the Committee found that close to the finish line Mr Riddell allowed his mount to shift in several horse widths and in an abrupt manner when insufficiently clear of ROCKABYEBABY. As a result that runner was forced inwards clipping the heel of ALL ROADS just after the finish line nearly dislodging Ms S Collett. It was evident that ROCKABYEBABY shifted in when her rider was trying to regain her seat in the saddle. As a consequence SEVENTEEN SEVENTY was crowded and clipped a heel of SMART DRAGON and blundered badly. It is clear that Mr Riddell needs to exercise greater care when shifting ground in the future. The Committee deemed the level of carelessness displayed by Mr Riddell was in the high range.
The JCA Penalty Guide starting point for high range carelessness is 10 days. The Committee adopted 11 days as the starting point given the consequential impact to the affected runners and the seriousness of the breach.
Mr Riddell’s careless riding record in the last 12 months is appalling and this necessitated a further 2 day uplift in penalty.
The mitigating factor was Mr Riddell’s admission of the breach for which he was afforded a 1 day discount.
In assessing penalty the Committee had regard for the Premier / Iconic race meetings that Mr Riddell will miss during his suspension.
After taking into account all the above factors the Committee considered that an appropriate suspension was 12 national riding days.
