As the breach was admitted we find the charge proved.

Penalty:

Accordingly and under the provisions of rule 1106 (2) we suspend Mr Du Plessis from riding in races which is to start after racing on 10 November and conclude after racing on 15 November 2012 (4 days).

Facts:

Following Race 1 an information was filed pursuant to Rule 638 (1)(d).  The informant Mr J Oatham alleged that Mr M Du Plessis rider of BONINSKY permitted his mount to move inwards when insufficiently clear taking ANNIE HIGGINS inwards crowding INANOFF which was checked.

Submissions for Decision:

Mr Williamson demonstrated the video films which showed BONINSKY racing in the middle of the track soon after the start.  The films clearly showed Mr Du Plessis then angle his mount in taking the line of ANNIE HIGGINS when approximately 1/4 lengths clear.  This resulted in contact between ANNIE HIGGINS and INANOFF which caused INANOFF to lose its rightful line of running and be checked.

Mr Du Plessis in admitting the breach had nothing to say when asked.

Submissions for Penalty:

Mr Oatham said Mr Du Plessis had a clear record in NZ since 1st August when he returned from Hong Kong.  He submitted that today's breach was at the low end as Mr Du Plessis was almost clear when he moved across.

Mr Du Plessis told the committee he had commitments up to and including 10 November.

Reasons for Penalty:

The committee considered carefully all evidence and submissions.  In mitigation Mr Du Plessis has an excellent record and has admitted the breach.  We find his carelessness to be at the low end as Mr Du Plessis misjudged the distance by a small margin when he took the line of ANNIE HIGGINS.
