As the breach was admitted we find the charge proved.

Penalty:

Accordingly and under the provisions of rule 1106(2) we suspend Mr Bosson from riding in races which is to start after racing on 9 March and conclude after racing on 22 March 2013 (6 days).  The Waipa meeting on 14 March has been cancelled so has not been considered.

Facts:

Following race 9 an information was filed pursuant to rule 638(1)(d).  Mr Neal alleged that near the 450 metres Mr Bosson angled his mount SANGSTER inwards when not clear of CROCODILE CANYON (D Walker) which was checked.

Submissions for Decision:

Mr Oatham demonstrated the relevant video films pointing out SANGSTER racing in a 3 wide position approaching the 450 metres.  Racing on his inside was CROCODILE CANYON (D.Walker).  Soon after this point Mr Bosson allowed his mount to roll in and take the line of CROCODILE CANYON.  This caused Mr Walker to check for 2 or 3 strides to avoid getting on the heels of SANGSTER.  Mr Oatham submitted that Mr Bosson was not the required distance clear when moving in.

Mr Bosson, in admitting the breach, said he believed Mr Walker did not really have to check his mount and it was more of a case of him having to ease.  He said he was going so well at the time which accentuated the movement but admitted rolling in.

Submissions for Penalty:

Mr Neal produced Mr Bosson's record which showed 3 suspensions in the last 12 months. He said that while he considered this breach to be at the lower end of carelessness Mr Walker was entitled to be where he was.  He submitted this was an error of judgement on Mr Bosson's part but reminded the committee the status of the race which should be reflected in the penalty.

Mr Bosson said he had commitments until after racing on 9 March and on questioning from the committee confirmed he did not intend riding at the up-coming Invercargill or Ashburton meetings.

Reasons for Penalty:

The committee carefully considered all evidence and submissions.  In Mr Bosson's favour are his admission of the breach and his good record.  However the aggravating factor is that the breach occurred in a group 1 race caused by Mr Bosson allowing his mount to roll in when insufficiently clear.  The committee independently assesses his carelessness at the lower end.  We have adopted a 5 day starting point for assessing penalty and after taking all the above into account find the appropriate penalty is a 6 day suspension.
