As the breach was admitted we find the charge proved.

Penalty:

Accordingly, and under the provisions of rule 1106 (2), we suspend Mr Dye from riding in races which is to start after racing on 13 March and conclude after racing on 22 March 2013 (4 North Island days).  The committee did not take into account the Waipa meeting on 14 March because it has been cancelled.

Facts:

Following race 4 an information was filed pursuant to rule 638 (1) (d).  The informant alleged that near the 100 metres Mr R Dye angled his mount COURIER outwards when not clear of KOOL GAL (M Coleman) who was checked and GOLD ROCK (M Wenn) who was hampered.

Submissions for Decision:

Mr Oatham demonstrated the video films which showed COURIER racing on the rail approaching the 100 metres.  Racing in front of him was TAKE OVER and on his outside was KOOL GAL.  Soon after this point the films showed TAKE OVER move in slightly and Mr Dye angling off its heels to the outside to gain a clear run.  Mr Oatham submitted that Mr Dye was a bare length clear of KOOL GAL when moving out causing Mr Coleman to check and consequently hamper Miss Wenn.

Mr Dye, in admitting the breach, said TAKE OVER, who was in front of him moved in 2 horse-widths which caused him to angle out off his heels.  He said but for this he would have stayed on the rail.  However he agreed he was careless to a minor degree by moving into the line of KOOL GAL.

Submissions for Penalty:

Mr Neal submitted that Mr Dye had only occurred 1 suspension in the last 12 months.  He conceded that TAKE OVER has moved in slightly which narrowed the run for Mr Dye but clearly he was not sufficiently clear of KOOL GAL when moving out.  He submitted the breach was slightly below mid-range.

Mr Dye said he had commitments until after racing on 13 March and was only riding in the North Island.

Reasons for Penalty:

The committee carefully considered all submissions and evidence.  In mitigation Mr Dye has a very good record and has admitted the breach.  The committee also takes into account the inward movement of TAKE OVER.  However Mr Dye did fail his obligation of being 2 lengths clear when moving out.  The committee independently assesses Mr Dye's carelessness to be towards the lower end.
