--Following Race 6 an Information was filed pursuant to rule 638 (1) (D). The Informant, Mr George alleged that Mr Peard, rider of VANTASTIC, allowed his mount to shift out when not clear of VICKEZZ CHARDONNAY (C Grylls) who was checked.

--Following Race 6 an Information was filed pursuant to rule 638 (1) (D). The Informant, Mr George alleged that Mr Peard, rider of VANTASTIC, allowed his mount to shift out when not clear of VICKEZZ CHARDONNAY (C Grylls) who was checked.
--Mr Peard admitted the breach.
--Mr Coles demonstrated the video films and showed at a point passing the 300 metres, Mr Peard angle his mount VANTASTIC out into a marginal gap when only ¾ length clear of VICKEZZ CHARDONNAY on his outside. This movement caused Mr Grylls to take hold of his mount.
--Mr Peard admitted he moved out approximately ½ a horse width but in his opinion it was only a minor breach of the rule.
--PENALTY SUBMISSIONS
--Mr George produced Mr Peard’s record which showed 2 suspensions in the last 12 months. He submitted this was at the mid range of carelessness and as this was a listed race believed a 5 day suspension was warranted.
--Mr Peard told the Committee that he only had commitments up to and including 10 March 2010 and he does not ride outside the North Island.
--PENALTY
--The Committee carefully considered all the evidence and submissions before imposing an appropriate penalty. Mitigating factors are Mr Peard’s admission of the breach and his good record. However these have to be balanced against the check received by Mr Grylls and the status of the race. The Committee considers the level of carelessness displayed by Mr Peard was relatively low. Accordingly we impose a suspension on Mr Peard from riding in races which is to start after racing on 10 March 2010 and conclude after racing on 18 March 2010 (5 days).
