As Mr Lammas admitted the breach we find the charge proved.
Penalty:
We grant Mr Lammas' request to seek a deferment to his suspension as per Rule 1106(2).
Accordingly, Mr Lammas had his license to ride in races suspended for a period to commence after racing on 11 April and conclude after racing on 18 April 2015 (4 North Island days).
Facts:
Following the running of race 3, R J Skelton Vase, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Williamson, alleged that Mr Lammas permitted his mount RESET THE TURBO to shift inwards when not sufficiently clear of HOWLAND (V Colgan) which was forced inwards crowding PINKO MOON (R Hutchings) which was severely checked near the 1100 metres.
Mr Lammas acknowledged that he understood the nature of the charge, the Rule and confirmed his admission of the breach.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Oatham identified on the video films PINKO MOON racing adjacent to the rail near the 1100 metres. He said on his outside was HOWLAND (V Colgan) and in front of him was Mr Lammas riding RESET THE TURBO in a 2 wide position. He said that Mr Innes the rider of DUKE OF SUSSEX was racing on the inside of RESET THE TURBO when it moved out to avoid heels. This forced Mr Lammas to ease his mount back from a 3 wide position to a 2 wide position. He noted that when Mr Lammas went to steady his mount there were 2 horses racing on his inside with Mr Colgan being a ½ to ¾ of a length behind him when Mr Hutchings was severely checked. He conceded that all runners were fairly inexperienced.
Mr Lammas told the Committee that he did come in but the manoeuvre was gradual and there was no contact. He said HOWLAND contributed to the incident by running away from his mount.
In response to a question from the Committee, Mr Lammas said he did not realise there were 2 horse racing on his inside.
Submissions for Penalty:
Mr Williamson produced Mr Lammas’ record which showed no previous breaches under this Rule in the last 12 months. He said Mr Lammas had been on the side line through injury and has had 104 rides to date this season. He submitted the interference was greatly exaggerated due to the poor reaction of HOWLAND. He submitted the interference was low to mid – range and a penalty should reflect that.
Mr Lammas advised that he had upcoming engagements at Tauranga on 11 April, and sought a deferment to any proposed suspension.
Mr Lammas confirmed that he rode all over the North Island for Mr Bridgeman and it was his intention to ride at all the up - coming meetings.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented. We have adopted 5 riding days as the starting point in considering the term of suspension for this careless riding charge. The mitigating factors are Mr Lammas’ admission of the breach, we assess the carelessness as low and his very good record in relation to this Rule. While we concede that PINKO MOON did receive a severe check we believe that HOWLAND who was having its first race day start contributed to the interference by racing greenly when over reacting to the inward movement of RESET THE TURBO.
After taking into account all the above factors the Committee considers an appropriate penalty is a 4 day suspension.
