Following Race 5 an Information was filed pursuant to rule 871 (3). The Informant, Mr J Oatham, alleged that Mr D Bothamley, rider of the winner KIDUNOT, made a celebratory gesture prior to the winning post.
--Mr Bothamley admitted the breach.
--Mr Oatham told the Committee that just short of the line Mr Bothamley stood up and waved his whip in the air. He said while he could understand Mr Bothamley’s exuberance it was clearly a breach of the rules.
--He submitted a fine of $200 - $300 would be appropriate.
--Mr Bothamley had nothing to say.
--PENALTY
--The Committee took into account all submissions and considered Mr Bothamley’s actions were at the low end of carelessness. However they reminded him of his obligations and imposed a fine of $250.00.
