As Ms Collett admitted the breach we find the charge proved.

Penalty:

We grant Ms S Collett’s request to seek a deferment to her suspension as per Rule 1106(2).

Accordingly, we impose a suspension on Ms S Collett which will commence after racing on November 9 and conclude after racing on November 13 (4 days).

Facts:

Following race 5, Bach Espresso 1400, an Information was filed pursuant to Rule 638(1)(d). The Informant, Mr Oatham, alleged that near the 100 metres Ms S Collett allowed her mount CIVETTA to shift out under pressure crowding FIRST CLASS (C Grylls) who was checked.

Ms Collett acknowledged that she understood the nature of the charge and the Rule.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Williamson identified that CIVETTA shifted out under pressure near the 100 metres and as a result moved into the rightful running line of FIRST CLASS. He said Ms Collett was only a bare length clear when shifting out.

Ms Collett admitted that her mount continued to shift out when she was not the required distance clear.

Submissions for Penalty:

Mr Oatham produced Ms Collett’s record which showed 2 previous breaches under this Rule in the last 12 months. He described Ms Collett’s record as relatively good and assessed the level of carelessness as low to mid - range. He noted Ms Collett admitted the breach and submitted a 4 to 5 day suspension would be appropriate.

Ms Collett advised that she had upcoming commitments at Te Rapa on November 9, and that any period of suspension could commence after that.

In response to a question from the Committee, Ms Collett submitted that she rode at Riccarton approximately 2 months ago for Ms Latta.

Ms Collett submitted that she was intending to ride at Riccarton on the 13th and 16th of November.

Mr Oatham had no objection to Ms Collett’s submission regarding Riccarton.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented. We have adopted 5 riding days as the starting point in considering the term of suspension. The mitigating factors are Ms Collett’s admission of the breach and her good record in relation to this Rule. We assess the level of carelessness to be in the low to mid-range. We note that Ms Collett continued to ride her mount forward when it was shifting ground.

After taking into account all of the above and placing emphasis on the mitigating factors we consider an appropriate penalty is a 4 day suspension.
