Decision: Following race 9 an information was filed pursuant to Rule 876 (1) by the informant, Mr P Moroney.  He alleged that PRIZE LADY and GALLIONS REACH, placed 1st and 2nd by the judge, interfered with the chances of RESOLUTION, placed 3rd by the judge. 

Following race 9 an information was filed pursuant to Rule 876 (1) by the informant, Mr P Moroney.  He alleged that PRIZE LADY and GALLIONS REACH, placed 1st and 2nd by the judge, interfered with the chances of RESOLUTION, placed 3rd by the judge.  He said the interference occurred in the final straight.

Mr Moroney demonstrated the video film and showed in the run to the post his horse RESOLUTION receiving buffeting from GALLIONS REACH on her inside and PRIZE LADY on her outside.  Mr Moroney said that firstly GALLIONS REACH ran out and then PRIZE LADY ran in.  As a result of this RESOLUTION was denied the chance of winning the race, through the tightening it received.

Ms Lisa Cropp, rider of RESOLUTION, said she had nowhere to go and believed this was some of the worst interference she had experienced.  She believed she should have won the race and went on to say she had been trying to keep Ms S Spratt off her, and then PRIZE LADY came in and squeezed her as well.

Mr G Sanders, trainer of PRIZE LADY, said that initially Ms Cropp, riding RESOLUTION, was almost leading the field when she received pressure from GALLIONS REACH.  He said RESOLUTION was not good enough to hold her position and it was Ms Cropp making contact with the hindquarters of PRIZE LADY that caused his horse to move in slightly.

Mr M Sweeney, rider of PRIZE LADY, said Ms S Spratt had come out on GALLIONS REACH and put pressure on RESOLUTION and if anything his mount PRIZE LADY had been turned inwards by RESOLUTION.

Mr R Yuill, trainer of GALLIONS REACH admitted that his horse initially moved out, when clear, and from there on kept a straight line.  He believed any pressure received was from the outside.

Ms S Spratt, rider of GALLIONS REACH, confirmed Mr Yuill’s evidence.

Chief Stipendiary Steward Mr C George, when asked for his interpretation of the incident, said that the initial movement came from GALLIONS REACH which moved out, but said that given the margin of two lengths between 2nd and 3rd he believed the judge’s placings should stand.

DECISION

--

The committee carefully considered all evidence and reviewed the video films.  While we concede RESOLUTION did receive some buffeting we are of the opinion that RESOLUTION was initially on terms with the leaders and was starting to lose ground before the buffeting occurred.  It was clear to us that all three horses were inconvenienced at different stages.

--

Taking into account the inconvenience that RESOLUTION received and balancing that with the two length margin between 2nd and 3rd , we are in no doubt that the chances of RESOLUTION finishing in a better place were not affected.

Accordingly, the protest is dismissed and the judge’s placings shall stand.
