Pursuant to Rule 648 (3) the Committee determined that TE AKAU CALIBURN be disqualified from the race.

Facts:

This Request for a Ruling was filed pursuant to Rule 648(3) and arises following the running of Race 5, the Vector Wero Whitewater Park 2100. The Informant, Senior Stipendiary Steward Mr M Williamson, alleged that the rider TE AKAU CALIBURN weighed in 1.7 kg underweight.

Rule 648(3) provides that:

If, on being weighed in, a Rider cannot draw the proper weight (meaning thereby the weight allotted by the Handicapper for his horse to carry and adjusted only by any re-handicap, by having been declared overweight, by penalty or by authorised allowance) the Clerk of the Scales shall allow such rider 0.5 kg and if the allowance is not sufficient to enable the proper weight to be drawn then subject to sub-Rule (4) of this Rule then in addition to any other penalty which may be imposed the horse shall be disqualified for the Race.

Submissions for Decision:

Mr Williamson said that during the running of the race the saddle of TE AKAU CALIBURN (J KAMARUDDIN) slipped. He demonstrated the final stages of the race and identified that in the run up the home straight near the 300 metre mark the lead bag and pad came adrift and fell onto the track. As a consequence, the Clerk of the Scales, Mr R Sanders notified Stewards that TE AKAU CALIBURN weighed in 1.7 kg light. This is inclusive of Mr Kamaruddin’s apprentice allowance and also takes into account the allowance for his protective vest.

By way of explanation, Mr Harris advised, on behalf of Mr Kamaruddin, that he checked the girth after the horse was unsaddled and found that it had too much stretch and this possibly caused the saddle to slip. He added that there was a lot of lead in the weight bag which may have also been a contributing factor.

Reasons for Decision:

After considering the submissions the Committee was satisfied that Mr Kamaruddin weighed in 1.7kg under his weigh out weight. The Committee accepts that the reason for the weight discrepancy is due to the saddle of TE AKAU CALIBURN slipping during the running and the loss of the lead bag.
