As the breach was admitted we find the charge proved.
Penalty:
The committee has adopted 5 days as a starting point in assessing an appropriate penalty. After taking all the above factors into account we impose a 4 day suspension.
Accordingly Miss Holmquist is suspended from after racing on 11 June until after racing on 19 June (4 days). These include 15 June Te Teko, 16 June Whanganui, 18 June Ruakaka and 19 June Te Aroha.
This suspension comes under the provisions of rule 1106 (2).
Facts:
This is an adjourned enquiry resulting from race 9 at the Auckland Racing Club on 4 June 2016. This hearing was adjourned because there was no suitable representation for Miss Holmquist.
Following race 9, the Auckland Co-Op Taxis 1600, an information was filed persuant to rule 638 (1) (d). The informant alleged that Miss Holmquist angled her mount, SING FOR THE SUN, outwards when not sufficiently clear of SPECIAL UNIT which was checked near the 200 metres.
Mr Oatham demonstrated the video films pointing out SING FOR THE SUN racing at the rear of the field upon entering the final straight. He said that initially SING FOR THE SUN was racing 3 lengths behind HAYLEY GRACE. When SING FOR THE SUN was making up ground Miss Holmquist opted to angle off the heels of HAYLEY GRACE who was racing directly in front of her. This resulted in her moving into the line of SPECIAL UNIT which had to be checked. Mr Oatham conceded that Mrs Thornton, rider of HAYLEY GRACE, shifted out and TOO GEE's had moved in slightly into the line of SPECIAL UNIT.
Miss Holmquist said Mrs Thornton had shifted out which caused her to angle her mount out to avoid that runner's heels which she admitted caused the check to SPECIAL UNIT. In hind sight she should have taken a hold of her mount or gone to the outside.
Submissions for Penalty:
Mr Williamson told the committee that Miss Holmquist had only occurred one charge in the last 12 months which he said was a good record. He believed her level of carelessness in this case was low to mid and said Miss Holmquist made an error of judgement when angling off the heels of Mrs Thornton's mount. He submitted a suspension in line with those facts would be appropriate.
Miss Holmquist said she had commitments up to and including Te Rapa on 11 June and she had been riding on industry days in the central districts recently. She added she had rides in Taranaki on 9 June.
Reasons for Penalty:
The committee carefully considered all the evidence and submissions as presented. In mitigaiton Miss Holmquist has a very good record and has admitted the breach. In assessing penalty the committee has also taken into account the outward movement from Mrs Thornton's mount and to a lesser degree the inward movement by TOO GEE'S. These factors must be balanced against the consequence which was the check received by SPECIAL UNIT.
