The committee is therefore satisfied after taking all the above into account that if SUPER TROUPER had not received the interference from CAELLUM she would have beaten that runner.

Accordingly the protest is upheld and the placings shall now be:

1st    No 3     MR KNOWITALL

2nd   No 5    ABADDON

3rd    No 2    SUPER TROUPER

4th    No 1    CAELLUM

The committee ordered the payment of stakes and dividends accordingly.

Facts:

Following race 4, the Papatoetoe Glass 1200, a protest was lodged by the informant Mr M Hills.  He alleged that CALLEUM, placed third by the judge interfered with the chances of his horse, SUPER TROUPER, placed fourth by the judge.  He stated this interference occurred in the final straight. 

The judge's placings were as follows:

1st      No 3   MR KNOWITALL

2nd     No 5   ABADDON

3rd      No 1   CAELLUM

4th      No 2   SUPER TROUPER

The official margin between third and fourth was a neck.

The rule 642(1) reads:  if a placed horse or its rider causes interference within the meaning of this rule 642 to another placed horse, and the judicial committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse has such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with.

Submissions for Decision:

The Committee outlined the JCA policy for a protest hearing and there were no questions or objections.

Mr Hills demonstrated the video films pointing to his mount SUPER TROUPER being pushed across the heels of ABADDON near the 250 metres when he was at the girth of CAELLUM.  He said this interference cost him one and a half lengths and when he got his mount balanced again he finished off the race strongly to be within a neck of CAELLUM at the finish.

Mr Mirabelli said he agreed with the evidence of Mr Hills.

Miss Holmquist conceded that although there was movement from her mount there was also inward movement from ABADDON on the outside of SUPER TROUPER which contributed to the interference. She said SUPER TROUPER was not travelling well enough to take the gap and had 200 metres to make up any lost ground which it failed to do.

Mr Bishara agreed there was movement from both horses but said ABADDON moved more than CAELLUM. He said CAELLUM was holding SUPER TROUPER at the post.

Mr Williamson when asked for his assessment of the incident said that the films showed that at the 300 metre mark SUPER TROUPER was racing free of interference.  Shortly after this point he identified SUPER TROUPER getting crowded for racing room as a result of CAELLUM moving out when not the required distance clear.  Mr Williamson said there was no inward movement from ABADDON and the interference occurred when CAELLUM moved out a horse width and placed SUPER TROUPER in restricted racing room.  He said this cost SUPER TROUPER 3/4 length and noted the margin between the 2 horses was a neck.

Reasons for Decision:

The committee carefully considered all the evidence and submissions as presented and reviewed the video footage.  The committee is satisfied that CAELLUM moved out approximately one horse width at the 250 metres taking the rightful line of SUPER TROUPER when insufficiently clear of that runner.  This caused Mr Hills to take a hold of his mount and lose approximately one length.  We studied the head on film where the interference occurred and established that ABADDON shifted in slightly after CAELLUM had taken the rightful line of SUPER TROUPER.  The committee also established that after SUPER TROUPER received the check from CAELLUM and became balanced again she made up noticeable ground on that runner in the run to the post.
