Following Race 7 an information was filed pursuant to Rule 858 (1) (c) when it was alleged by the Informant Mr A Coles that Mr N Hanley, rider of the second horse, FEU D?AMORE deliberately touched J Gillies, the rider of the first horse, FAIR KING, with his whip prior to weighing in.

DECISION, REASON & PENALTY
--Following Race 7 an information was filed pursuant to Rule 858 (1) (c) when it was alleged by the Informant Mr A Coles that Mr N Hanley, rider of the second horse, FEU D?AMORE deliberately touched J Gillies, the rider of the first horse, FAIR KING, with his whip prior to weighing in. Mr Hanley pleaded guilty to the charge.
--Mr Coles said in his submissions that Mr Hanley had been completely honest about his actions and he (Mr Coles) was satisfied it was a congratulatory gesture on Mr Hanley's part.
--He believed a fine of $100 - $200 would be appropriate.
--Mr Hanley said he was only offering Mr Gillies a "well done" pat with his whip and really thought that was allowable as long as it was not with his hand.
--The Committee considered all submissions and is clearly of the view that Mr Hanley was only offering a congratulatory pat with his whip and there was no malice in his actions. However, they reminded Mr Hanley of his obligations under this Rule. We believe an appropriate penalty is a fine and accordingly impose an amount of $175 to be paid by Mr Hanley.
