After taking all the factors into account the committee finds the charge proved.
Penalty:
The committee has adopted 5 days as a starting point when assessing penalty. We believe that this term would normally be appropriate but as her term of suspension includes a premier day on 13th February and she has a clear record with a low level of carelessness today we have reduced the penalty to 4 days.
Therefore Mrs Tiley is suspended from after racing today, 4th February, until after racing on the 17th February (4 days). We did not take 6th February into account as declaration of riders had closed this morning. These days include 10th February Avondale, 13th Te Rapa, 14th Matamata and 17th February Te Aroha.
Facts:
Following the running of Race 5, the Barfoot & Thompson Twilight Cup, an information was filed pursuant to rule 638(1)(d). The informant alleged that Mrs L Tiley rider of THE JUSTICE LEAGUE allowed her mount to shift inwards when not sufficiently clear of OUR PINK DIAMOND (L Satherley) which was crowded inwards onto PRINCE OF PASSION (O Bosson) which was checked near the 1000 metres.
The rule reads as follows: A rider shall not ride a horse in a manner which the judicial committee considers to be careless.
Submissions for Decision:
Mr Oatham demonstrated the video films pointing out firstly PRINCE OF PASSION racing on the rail approaching the 1000 metres. To his outside and 2 off the rail was OUR PINK DIAMOND and behind her was THE JUSTICE LEAGUE. Travelling slightly ahead of these 3 horses and in a loose 4 wide position was BULLDOZER (D Nolan) As they approached the first corner Mr Oatham showed Mrs Tiley, whose mount was in a 3 wide position, riding forward attempting to improve insde BULLDOZER. He described this as a marginal run and questioned why Mrs Tiley had attempted it. Mr Oatham said there was always a gap between BULLDOZER and THE JUSTICE LEAGUE but Mrs Tiley allowed her mount to shift in when there was insufficient room for the runners inside her. He pointed out Mrs Satherley turning OUR PINK DIAMOND'S head out trying to give Mr Bosson room which she could not do. The end result was that Mrs Satherley had to check causing her to move into the line of Mr Bosson who at this stage was only 3/4 length behind her. Mr Bosson then had to take a strong hold causing him to lose momentum and valuable ground. Mr Oatham concluded by saying Mr Nolan maintained his 4 wide position throughout.
Mrs Tiley questioned Mr Oatham as to whether there was a gap between her mount and Mrs Satherley's to which he replied in the negative. He also denied saying contact was made between the two. Mrs Tiley also asked him how many strides she had moved in and he replied "four to five".
Mrs Satherley (rider of MY PINK DIAMOND) was then called as a witness and said she wanted to be one off the fence at the point in question. She said however she received pressure from Mrs Tiley on her outside causing her to roll in for one stride which resulted in the interference to Mr Bosson. She stated she tried to hold her one off position but could not do so because of the pressure from Mrs Tiley.
Mr Bosson (rider of PRINCE OF PASSION) was then called as a witness and said he was racing on the rail and 1/2 length inside and behind Mrs Satherley. He said at the 1000 metres he received pressure from Mrs Satherley to a point that he had to take a hold and check out of it.
Mr D Nolan (rider of BULLDOZER) was then called and said he was racing 4 wide and maintaining his line. He said he was surprised to see Mrs Tiley coming up on the inside of him.
Mrs Tiley said there was no doubt that Mr Bosson did receive a check but it was hard to put the sole blame on her. She said she followed Mrs Satherley across and only rolled in for a brief stride but corrected quickly. Mrs Tiley concluded by saying Mrs Satherley's mount was racing unkindly and repeated it was a little bit tough to blame her alone.
Mr Williamson, in summing up, said Mr Oatham had clearly stated the stewards' assessment of the incident. He added that Mr Nolan was caught by surprise when Mrs Tiley improved up inside him. He said Mr Nolan tried to give Mrs Tiley more room but was already racing in a loose 4 wide position. Mr Williamson stated that Mrs Satherley knew that Mr Bosson was there and turned her mount's head outwards trying to relieve the pressure. He concluded that Mrs Tiley continued to improve forcing OUR PINK DIAMOND inwards and forcing Mr Bosson to check. He conceded the movement was not great.
Mrs Tiley, when given the opportunity to sum up, said she had covered everything in her evidence.
Reasons for Decision:
The committee carefully considered all evidence and submissions and reviewed the video films. The committee is satisfied that at the 1000 metres Mrs Tiley allowed her mount to move in when not the required distance clear of MY PINK DIAMOND on her inside. We found that Mr Nolan did not contribute to the incident as he maintained his loose 4 wide position throughout. The films clearly show that Mrs Tiley has come from behind BULLDOZER and OUR PINK DIAMOND at the 1200 metres. She then dictated that runner for 4 or 5 strides and although Mrs Satherley tried to relieve the pressure on Mr Bosson she could not do so because of the inward movement of Mrs Tiley. The evidence of the three witnesses was also compelling.
Submissions for Penalty:
Mr Williamson said Mrs Tiley had only just resumed riding recently after a long absence. He said she had ridden apporoximately 10 times since resuming without incurring any charges. He submitted today's breach to be at the low end and asked the committee to treat the penalty as such.
Mrs Tiley confirmed she had no commitments after today and confirmed she was currently only riding up north and had not ridden on an industry day outside this area in recent times.

This must be balanced against the fact that 2 horses were checked with Mr Bosson in particular losing momentum and ground.
