After taking all the above into account the protest is dismissed and the judge's placings shall stand.

We order the payment of stakes and dividends accordingly.

Facts:

Following race 1, the Simply Squeezed 1400, a protest was lodged pursuant to rule 642 (1).  The informant, Mr Mirabelli, alleged that THATSFORSURE, placed first by the judge interfered with the chances of his horse LEICA GLORY, placed second by the judge.  This interference was alleged to have occurred in the final straight.

The official margin between first and second was 1 1/2 lengths. 

Rule 642(1) reads:  if a placed horse or its rider causes interference within the meaning of this rule 642(1) to another placed horse, and the judicial committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with. 

Submissions for Decision:

Mr Mirabelli pointed out on the video films at a point approaching the 300 metres THATSFORSURE who was racing on the outside of LEICA GLORY, come across and severely check his horse. He said this cost LEICA GLORY 2 lengths and stopped his momentum. He added the official margin between the 2 horses was a length and a quarter.

Mr Colgan said he did have to take a hold of his mount but admitted the winner had come from behind him. He stated the winner had slowly moved in and believed the interference had cost him a length.

Mr Greene said at the 300 metres horses were jostling for positions and he identified MAKDANIFE had come out onto SEBRING DRAGON. He said THATSFORSURE was sufficiently past those 2 horses when the interference occurred.

Mr Coleman said there was minimal inward movement from his mount and believed the interference came from the inside 2 horses. He concluded by saying his horse did not cause the interference.

Mr Williamson, when asked for his assessment, said there was only slight movement from THATSFORSURE and the general cause of the interference came from MACDANIFE on the inside. He said the stewards did not support the protest.

Reasons for Decision:

The committee carefully considered all the evidence and reviewed the video films.  We established that at the 300 metres MACDANIFE shifted ground out onto SEBRING DRAGON who in turn shifted out onto LEICA GLORY which was checked.  At that point THATSFORSURE came from behind and went past LEICA GLORY at the time of the interference. 

The committee is satisfied that THATSFORSURE'S slight inward movement has no bearing on the outcome of the race.
