Accordingly we impose a suspension on Mr Grylls from riding in races which is to start after racing on 11 December and to conclude after racing on 17 December 2010 (4 riding days).

Facts:
Mr Coles, Stipendiary Steward, demonstrated the video films and pointed out to the committee MAE JINX racing in a 3 wide position nearing the 150 metres. It was then clear on the film Mr Grylls allowed his mount MAE JINX to shift inwards for a run on the inside of DENVER. However when doing so he was not the required distance clear of QUEEN SABEEL (M Wenn) who received a sharp check as a result.
Mr Grylls in admitting the charge said that DENVER had rolled in when going for the run and he thought there was room for 2 horses. He believed that through DENVER rolling in the check to QUEEN SABEEL was accentuated.
Submissions for Penalty:
Mr Oatham, Stipendiary Steward, produced Mr Grylls record which showed 3 previous charges in the last 12 months. He said Mr Grylls was a national rider and believed he had a very reasonable record. He submitted that QUEEN SABEEL did receive a severe check through the inward movement of Mr Grylls. The mitigating factor was that DENVER did roll in contributing to that check; he submitted a suspension at the lower end would be appropriate.
Mr Grylls submitted that he had firm commitments up to and including the Te Rapa meeting on 11 December 2010.

The committee carefully considered all evidence and submissions. Mr Grylls was informed we have adopted 5 riding days as the starting point in considering the term of suspension for careless riding charges. Mitigating factors are Mr Grylls admission of the breach, his very good record and the part that DENVER played in the incident. It was clear that DENVER rolling in contributed to the interference; however Mr Grylls was not the required distance clear of QUEEN SABEEL when moving in. Taking the mitigating factors into account we believe the suspension can be moved down from the starting point and the appropriate penalty is one of 4 days.
