An information was filed pursuant to Rule 828 (7) (B) by the informant Mr G Vile, requesting permission to scratch his horse ALL SQUARE in Race 8.

Stipendiary Steward Mr Oatham said in his submissions that the track was rated at 4.6 and heavy at scratching time, times were consistent with that and that there had been no material change since that time. He also said the horse had not performed on heavy tracks.

Mr Vile said at scratching time of 7:30 he was happy at the 4.6 rating and this was just heavy in his opinion and he was willing to start. Later on, he believed the track was worse than that, and ALL SQUARE would just not perform.

DECISION :

--

The Committee considered all submissions and while having sympathy with Mr Vile that the track was somewhat heavier than anticipated, we cannot escape the fact that the track was rated Heavy at scratching time and the times were consistent with the rating at that time. Accordingly we decline Mr Vile's request.
