As the breach was admitted we find the charge proved.
Penalty:
After taking all the above into account and under the provisions of rule 1106(2) we impose a suspension on Miss Woods from riding in races which is to start after racing on 4 April and conclude after racing on 10 April 2012 (4 days).

Facts:
Following race 9 an information was filed pursuant to rule 638(1) (d). The informant, Mr J Oatham, alleged that Miss L Woods permitted her mount OPAL CREEK to shift inwards near the 1300 metres when not sufficiently clear of RASTEAU (Mr R Hutchings). In turn RASTEAU was forced into the line of SPEECH CRAFT (Mr C Grylls) which was checked.
Submissions for Decision:
Mr Coles demonstrated the video films which showed OPAL CREEK racing in a midfield position soon after the start. It was evident that Miss Woods started moving her mount in towards the rail but in doing so dictated the line of RASTEAU on her inside. This caused RASTEAU to move in and directly into the line of SPEECH CRAFT. Mr Coles submitted Miss Woods was a bare length clear of RASTEAU when moving in and that Mr Grylls riding SPEECH CRAFT lost approximately 2 lengths through having to check.
Miss Woods in admitting the breach said she thought Mr Hutchings had kicked up when she started moving in and that he may have over reacted to her inward movement.

Mr Oatham said Miss Woods had a clear record and submitted her carelessness today was in the low to mid range.
Miss Woods said she had commitments up to and including 4 April.
Reasons for Penalty:
The committee carefully considered all evidence and submissions. It was clear that Miss Woods had made an error of judgement and was certainly not the required distance clear when moving in. However we find the breach to be at the low end of carelessness which must be considered along with her admission of the breach and her excellent record.
