DECISION & REASON:
Following race six an information was filed pursuant to Rule 638(1)(d). The informant, Mr Oatham, alleged that Mr M Cameron, rider of BALLYBIT, shifted out to obtain clear running near the 250 metres. This movement caused crowding to MISS SHARAPOVA (M Coleman), FASHION ROCKS (O Bosson) and inconvenienced DARK FLIGHT (H Bowman).
M Cameron pleaded guilty to the charge.
--Mr Williamson demonstrated the video films which showed BALLYBIT racing in a position down near the rails approaching the 250 metres. It was evident that BALLYBIT was traveling very well which forced Mr Cameron to take a hold of his mount to avoid the heels of MIKO (C Grylls) who was directly in front of him. Mr Cameron then allowed his mount to shift out and dictate the line of MISS SHARAPOVA when only 1½ lengths clear of that runner. This caused MISS SHARAPOVA into the line of FASHION ROCKS who received quite a sharp check. DARK FLIGHT was also inconvenienced.
--Mr Williamson did say the interference was not all caused by Mr Cameron, as Mr Waddell (CHOCOLATER) had initially caused inconvenience to BALLYBIT, but this did not excuse Mr Cameron from then moving out as he did.
--Mr Cameron had nothing to add, agreeing with Mr Williamson’s evidence.
--PENALTY SUBMISSIONS:
Mr Oatham produced Mr Cameron’s record which showed two charges in the last 12 months –
13.4.09 – 5 days
23.10.09 – 5 days
Mr Oatham said although there was significant interference there were some mitigating factors, namely the contribution from Mr Waddell’s mount. He submitted this offence was in the mid range of carelessness.
--When Mr Cameron was asked of his commitments he said he had none after 1.2.10.
--PENALTY:
The Committee considered all evidence and submissions before imposing an appropriate penalty. Mr Cameron’s record, his guilty plea and the part played by Mr Waddell were all taken into account. However, the aggravating factor was the sharp check received by Mr Bosson which was caused solely by Mr Cameron moving out when not clear.
Accordingly we impose a suspension on Mr Cameron from riding in races which is to start after racing on 1.2.10 and conclude after racing on 10.2.10 (five days).
