DECISION & REASONS:
--Information 32026 filed by Licensed Trainer Simon Rees instigated this Protest under Rule 876 (1) of the Rules of Racing following Race 9 alleging that SUPERALLOY or its rider, Michael Coleman, placed second by the judge interfered with the chances of SENORITA HEIGHTS placed fourth. The interference was alleged in the final straight and the margin between second and third was three quarters of a length with a further three quarters of a length to the fourth horse.
----Mr Rees represented the connections of SENORITA HEIGHTS and Mr R Collett the Trainer of SUPERALLOY, was present representing its connections. Also present were riders Lee Callaway (SENORITA HEIGHTS) and Michael Coleman (SUPERALLOY). Stipendiary Steward C George was also present.
----Mr Rees demonstrated the incident on video and this was explained in further detail by Lee Callaway. He demonstrated how SUPERALLOY had taken his line causing him to check and change ground and it had cost him a good couple of lengths with about 150 metres to run to the finish.
----Mr Coleman said, from looking at the video, it showed how he had come from behind the fourth horse and he was always going better than it. While he agreed he had shifted in the other horse was also shifting in and the third horse was comfortably holding the fourth horse throughout. He believed SENORITA HEIGHTS was therefore always going to finish in the position it did. He said that it was an exaggeration to suggest it lost two lengths in the incident. Mr Callaway may have had to take a hold for two or three strides but the interference had been minimal and made no difference to the placings.
----Mr. George told the committee the video showed the second horse SUPERALLOY came from a position behind SENORITA HEIGHTS on straightening and getting down to the position where the alleged interference took place at the 150 metre mark clearly went past that horse. Considering the margin at the finish was three quarters of a length to the third horse in his opinion it had not cost SENORITA HEIGHTS that distance and the protest should be dismissed.
----After taking into consideration the evidence presented and reviewing the video the Committee finds that it agrees with the interpretation by Mr George. While interference has occurred as alleged which has cost SENORITA HEIGHTS some ground, given the margin of three quarters of a length and the fact that SUPERALLOY has come from behind and was finishing so well, we are not satisfied that this justifies exercise of our discretion and accordingly the protest is dismissed.
----The refund of any deposit is ordered.
