DECISION & REASONS:
--Information 32025 filed by Licensed Trainer Frank Ritchie instigated this Protest under Rule 876 (1) of the Rules of Racing following Race 6 alleging that MANDELA or its rider, Grant Cooksley, placed first by the judge interfered with the chances of MAC FIVE placed second. The interference was alleged in the home straight and the margin between first and second was a neck.
----Mr Ritchie represented the connections of MAC FIVE and Mr R Yuill, the trainer of MANDELA was present and represented its connections. Also present were riders G L Cooksley (MANDELA) and A Peard (MAC FIVE). Stipendiary Steward C George was also present.
----Mr Ritchie demonstrated the incident on video, pointing out the respective runners and the outward movement by MANDELA, initially of half a mown strip without contact or causing his rider to stop riding but gradually moving wider to bump MAC FIVE causing contact and thereby take it off its rightful line. He suggested it was hampered by that movement and that it had cost it the race given the margin at the finish of a neck and that it was making ground on the winner at the finish.
----Mr Peard confirmed that his mount had been pushed all the way by MANDELA and had been forced off its line. He accepted he had still been able to ride out to the finish and had not been put off stride but he had been prevented from using his whip.
----Mr Yuill asked the Committee to note that MANDELA had always been ahead of MAC FIVE and in the initial stages there had been no contact so he had been entitled to be there. This had continued for the length of the straight and MAC FIVE had been unable to overtake at that stage. He accepted a slight touch had then occurred but this had not been sufficient, in his view, to cost MAC FIVE the chance of winning. Mr Cooksley confirmed that there had been slight contact late in the race but he felt MAC FIVE had had every chance before that to improve and had not done so and that his chances were not affected by the slight contact.
----Mr. George told the committee he believed there had been a slight bump but bearing in mind the margin of a neck at the finish it seemed doubtful that MAC FIVE?S chances had been affected sufficiently in the incident.
----After considering the above and the video the Committee is satisfied that there has been movement out as alleged and it has resulted in some contact more particularly in the latter part of the run but not earlier. Despite Mr Peard's belief that he had been pushed out all the way and that it had cost him the race we are not satisfied, given the margin of a neck at the finish and that he has not had to stop riding at any stage, that his chances have been affected and for that reason the protest will be dismissed.
----The refund of any deposit is ordered.
