This information alleged a breach of Rule 871(1)(d) for careless riding by jockey, Michelle Wenn in that ANNE BOLEYN (M Wenn) moved in when not clear of YENDARRA (R Allwood) leaving the straight on the first occasion with YENDARRA being checked and losing ground. The breach was not admitted.

The incident was demonstrated on video by Stipendiary Steward A. Coles. He pointed out the movement in by ANNE BOLEYN just after the winning post on the first occasion as it angled inwards towards the point of the corner when just a bare length clear of YENDARRA and Mr Allwood had to take hold of his mount losing ground in the incident.

Mr. George questioned Mr. Allwood about where Ms. Wenn was prior to the incident. He confirmed she was just over a length in front when he suffered a check as she came across and he was unable to maintain his line losing ground as a result. Ms Wenn asked if he had suffered any pressure from the inside and he agreed that there had been pressure from the mount ridden by Cameron Lammas on his inside as he eased off the heels of Chad Ormsby. He agreed that he could see Ms Wenn as she came across but he felt he was in more difficulty from the inside pressure than the outside movement.

Mr George showed the video again to Mr Allwood and put it to him that the incident he referred to was prior to the inward movement by Ms Wenn. Mr Allwood agreed but thought it continued on further. Mr George then showed him the video as the movement continued and he conceded that in fact Mr Lammas was forced back in by the subsequent movement of Ms Wenn and consequently Mr Allwoood had not been inconvenienced from the inside when the check came from Ms Wenn.

Ms Wenn explained that her concern arose from the contributing factors mentioned by Mr Allwood and she was confident the incident was of a minor nature so far as her part in it was concerned and might not otherwise have warranted a charge.

The Committee took into consideration all these matters and particularly the evidence of a contributing movement from the inside by Mr Lammas' mount. Mr Allwood agreed there had been such a movement and while Ms Wenn accepted she had moved in slightly when not the required distance clear of Mr Allwood she suggested that she had not caused him to react as much as the video showed and that it was caused more by the outward movement initially by Mr Lammas.

The incident was viewed again on the video and it is clear that the movement referred to by Mr Lammas occurred prior to Ms Wenn's movement and as Mr George stated to us Mr Lammas had himself been forced back in as Ms Wenn came across. We accept Mr George's interpretation and despite Ms Wenn's argument for the contributing factors we find there has been a breach of the rule on her part caused by her movement when not clear as alleged. We do, however, take into account what she has put to us as a mitigating factor.

The Committee after considering these matters and submissions on penalty finds that Ms Wenn has a very good record with no suspensions for over twelve months. It also accepts the mitigating factor above and while this breach is at the lower end of the scale for penalty purposes there should be a suspension at that level. Accordingly a three day suspension is ordered to take effect from the conclusion of racing on 4 October 2006 until the conclusion of racing on 11 October 2006 the meetings affected being those at Woodville, Matamata and Ruakaka.
