As Ms Loasby admitted the breach the charge was found to be proved.

Penalty:

Taking into account Ms Loasby’s good record, her ready admission of the breach and other recent penalties we imposed a monetary penalty of $300.

Facts:

Information number A6971 was presented to the Judicial Committee alleging a breach of Rule 614 (2) in that Tiffany Loasby omitted the lead bag when saddling PLATINUM COMMAND.

Rule 614(2) states:
A person must not be neglectful or careless in saddling a horse.

Mr Oatham explained how the error was picked up prior to Race 2 by the Stewards when PLATINUM COMMAND was presented at the plate inspection. The horse was re-saddled appropriately and there was no delay to the race as a result. Mr Oatham said the lead-bag weighed 1.1kgs so if the mistake had not been picked it there would have been far reaching consequences.

Ms Loasby said the mistake was completely unintentional. She had all the saddling gear in a pile and someone assisting had gone through it. As a result she just missed the lead bag.

Mr Oatham submitted that this breach could be dealt with by way of a monetary penalty. He cited other recent cases which had incurred fines in the range of $300 - $400. The higher level fine had been in relation to a Group 2 race.

Reasons for Penalty:

The Committee referred to the Penalty Guide for Judicial Committees which has, as a starting point for a breach of this type, a $500 fine.
Ms Loasby admitted the breach and the horse was re-saddled quickly with no delay to the start of the race as a consequence. We accept that it was an oversight and a genuine mistake.
