Following Race 6 an Information was filed pursuant to rule 638 (1) (d). The Informant, Mr Oatham, alleged that Mr D Walsh, rider of JOVIAL JOCK in Race 6, permitted his mount to shift inwards near the 1900 metres when not the required distance clear. This resulted in DAADS GIRL (A Peard) being forced inwards and into the line of REPOSADO (C Parish) who was checked.

Following Race 6 an Information was filed pursuant to rule 638 (1) (d). The Informant, Mr Oatham, alleged that Mr D Walsh, rider of JOVIAL JOCK in Race 6, permitted his mount to shift inwards near the 1900 metres when not the required distance clear. This resulted in DAADS GIRL (A Peard) being forced inwards and into the line of REPOSADO (C Parish) who was checked.
--Mr Walsh pleaded guilty to the charge.
--Mr Coles demonstrated the video films which clearly showed Mr Walsh at the 1900 metres move inwards towards the rail dictating the line of DAADS GIRL. Mr Coles said Mr Walsh was ¾ to 1 length clear of DAADS GIRL which resulted in this runner being checked. This consequently caused tightening to REPASADO who was following DAADS GIRL and was checked also. Mr Coles added that in mitigation MONTJEE had moved in accentuating the incident.
--Mr Walsh said he was initially going to defend the charge because he believed he didn’t start the interference. However he changed his plea because he finally conceded to taking the line of DAADS GIRL when not sufficiently clear.
--PENALTY SUBMISSIONS
--Mr Oatham said Mr Walsh had an outstanding record with no charges in the last 12 months. He reminded the Committee this was a premier day with this race worth $35,000. However he believed the penalty should be at the lower end.
--Mr Walsh said he had commitments until 7 November 09.
--PENALTY
--The Committee carefully considered all the evidence and submissions before imposing an appropriate penalty. In mitigation we have taken into account Mr Walsh’s outstanding record, his guilty plea and some contribution from the horse MONTJEE. However these factors have to be balanced against the aggravating factors of the checks to 2 horses and that this was a premier day. We consider Mr Walsh’s carelessness was in the lower end and accordingly we impose a suspension on Mr Walsh from riding in races which is to start after racing on 7 November and conclude after racing on 12 November 09 (4 days).
