Following race 9 an information was filed pursuant to rule 638(2). The informant Mr George alleged that Mr J McDonald riding the winner SILENT ACHIEVER made a celebratory gesture prior to the winning post.
Submissions for Decision:
Mr George demonstrated the video films which clearly showed Mr McDonald pumping his fists backwards and forwards prior to the winning post.
Mr McDonald had nothing to add.

Mr George submitted this was Mr McDonald's first charge under this rule and therefore a fine of $300 would be appropriate.

Reasons for Penalty:
The committee considered the evidence and submissions. We find this breach to be a relatively minor one as Mr McDonald's hand was kept low and he did not stand up in the saddle prior to the line. Also in mitigation are his admission of the breach and this was his first charge under this rule.
