As Mr Nason admitted the breach the Committee find the charge proved.
Penalty:
The Committee grant a deferment to Mr Nason’s suspension as per Rule 1106(2).
Accordingly, Mr Nason had his license to ride in races suspended for a period to commence after racing on 10 June and conclude after racing on 16 June 2017 (4 days).

Facts:
Following the running of race 4, Waste Management 1200, an Information was filed pursuant to Rule 638(1)(d). The Informant, Mr Oatham, alleged that Mr Nason allowed STRADIVARIUS to shift out near the 250 metres when not clear dictating AZ GIVEN out onto BREAK MY STRIDE ( D Johnson) which was checked losing ground.
Mr Nason acknowledged that he understood the Rule and confirmed his admission of the breach. Mr T Pike assisted Mr Nason at the hearing.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Coles using the available video footage identified that approaching the 350 metres Mr Nason was riding his mount forward when the horse continued to shift out. He said this resulted in AZ GIVEN being dictated out onto BREAK MY STRIDE which was checked. He said that Mr Nason shifted out 3 horse widths and he failed to stop riding and relieve the pressure.
Mr Nason said that he allowed his mount to drift out too far and said the incident was accidental.
Mr Pike said the incident was low range and the interference looked worse than it was due to the horses racing down the outside rail.
Submissions for Penalty:
Mr Oatham advised the Committee that Mr Nason has had 77 rides to date in New Zealand and this was his first offence. He said Mr Nason should be given credit for his admission of the breach and described the incident as being in the mid-range.
Mr Nason advised that he had engagements at Te Rapa on 10 June and any proposed suspension could start after that date.
Mr Oatham produced Mr Nason’s recent riding history which showed that he had riding in the Central Districts on a number of occasions. He advised that Mr Nason had 5 rides at Timaru yesterday and said that he was trying to establish himself as an NZ rider.
Mr Pike said that it was Mr Nason’s intention to travel throughout the country over the winter months.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented. The Penalty Guide for Judicial Committees recommends that the starting point for careless riding is a 5 day suspension.
The aggravating fact was Mr Nason continued to ride his mount forward when it was noticeably shifting ground outwards. This resulted in BREAK MY STRIDE receiving a sharp check when it ran out of racing room down the outside running rail. The Committee deemed the level of carelessness to be in the mid-range for which an uplift was applied.
The mitigating factors were Mr Nason’s admission of the breach and his excellent record which allowed a reduction in penalty.
It was relevant to recognise that Mr Nason had 5 rides yesterday at Timaru when considering penalty.
After taking into account all the above factors the Committee considered an appropriate suspension was 4 days.
