Decision:

As the breach was admitted we find the charge proved.

Penalty:

In normal circumstances the starting point for professional riders is 5 days. However as Mr Hillis is an an amateur rider and has limited riding opportunities the committee reflects this fact in the penalty it has imposed.

Accordingly after taking all the above into account we suspend Mr K Hillis from riding in races which is to start after racing today 3 June and conclude after racing on the 19 June ( 2 national amateur riding days).

Charge:

Following Race 6 The Dunstan Feeds 2400 an information was filed pursuant to rule 638(1)(d). The informant alleged that Mr K Hillis directed his mount outwards rounding the first turn when not clear making contact with RAISAFUASHO on a number of occasions forcing that runner wider on the track. 

Rule 638(1)(d) states : A rider shall not ride a horse in a manner which the Judicial Committee considers careless.

Facts:

Mr Oatham demonstated the video films and in particular showed an incident as the field were coming into the first turn out of the straight  He pointed out to the committee Mr K Hillis directing his mount out and forcing RAISAFUSHO out over considerable extra ground.  Mr Oatham said Mr Hillis seemed intent on going wider than he needed to and this resulted in him making contact with RAISAFUSHO on 2 or 3 occasions.

Mr K Hillis in admitting the breach had nothing to say when asked.

Mr W Hillis said his instructions were for Mr K Hillis to go wide for better ground.

Submissions for Penalty:

Mr Williamson said Mr Hillis had a clear record but was disappointed with his ride on this occasion as he had dictated RAISAFUSHO out to 5 to 6 wide position and making contact a number of times. He submitted a suspension of 2 National Amateur days would be appropriate.

Mr K Hillis said he rode at amateur races all over the country when he could obtain rides.

Reasons for Penalty:

The committee carefully considered all the evidence and submissions as presented. In mitigation Mr Hillis has admitted the breach, he has a clear record and has only had 8 previous rides. However the aggravating factor was that Mr Hillis had directed his mount out with little regard for Mr Roustoby (RAISAFUSHO) who was forced over a lot of extra ground.
