For the reasons above the committee is not satisfied that Another Emperor would have beaten Suki Lee if interference had not occurred. Accordingly the protest is dismissed.
The committee orders the payment of stakes and dividends as per the judge's placings.
Facts:
Following Race 2 The Climate Control 2 year Old, a protest was lodged pursuant to rule 642 (1). The informant Mr M Hills alleged that Suki Lee, placed first by the judge interfered with the chances of Another Emperor placed third by the judge. He submitted this occurred in the final straight.
Rule 642 (1) states: if a placed horse or its rider causes interference within the meaning of this rule 642(1) to another placed horse, and the judicial committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with.
The judge's placings were as follows:
10 SUKI LEE 1st
4 BANBURY 2nd
2 ANOTHER EMPEROR 3rd
The official margins were a short head between first and second and a neck between second and third.
Submissions for Decision:
Mr Hills demonstrated the video films and explained to the hearing that he was forced over extra ground from the 250 metres. He said there was a sharp outward movement from Suki Lee at the 100 metres which resulted in brief contact causing him to stop riding for 2 strides.
Mr O'Connor supported Mr Hills confirming that interference had occurred.
Mr Jago submitted that Mr Hills did not stop riding and he himself had to stop riding and straighten his mount. He said Suki Lee kept going away from Another Emperor in the run to the post and deserved to retain the race.
Mr O'Neil also said that Mr Hills never stopped riding his mount and he was adamant there was no contact between the 2 horses. He submitted that Another Emperor had every opportunity to beat Suki Lee if it had been going well enough.
Mr Williamson submitted there was merit in the protest and conceded that Suki Lee had shifted out a significant distance which forced Another Emperor over extra ground. However he said the stewards could not be decisive in saying that Another Emperor would have beaten Suki Lee.
Mr Hills had nothing further to say when asked to sum up.
Reasons for Decision:
The committee carefully considered all evidence and reviewed the films several times. While we concede that Suki Lee has drifted out at the 200 metres Mr Jago did take corrective action by changing whip hands. Although this outward movement continued after this point when Suki Lee was being hard ridden there was no contact between the 2 horses at any stage. Although they brushed together at the 100 metres, from that point on Suki Lee was always holding her advantage to the line.
