As the breach was admitted we find the charge proved.

Penalty:

Accordingly and under the provisions of rule 1106 (2) (a) we suspend Mr Shirahama's riding license from after the conclusion of racing on 5 October and concluding after racing on 11 October 2012 (4 days).

Facts:

Following race 2 an information was filed pursuant to rule 638 (1) (d).  The informant Mr Oatham alleged that Mr S Shirahama permitted his mount TIME LEGEND to shift inwards approaching the 100 metres when not sufficiently clear crowding TRAPICHE onto HAPPYTO KEEPA which were both checked.

Submissions for Decision:

Mr W Robinson demonstrated the video films and pointed out to the committee Mr Shirahama riding TIME LEGEND racing in a prominent position approaching the 100 metres.  Mr Robinson said Mr Shirahama then allowed his mount to shift in while continuing to ride forward with the whip.  He said Mr Shirahama was not sufficiently clear of the 2 runners on his inside and at no stage did he make enough effort to pull his horse off. 

Mr Shirahama in admitting the breach had no further comment to make.

Submissions for Penalty:

Mr Oatham said Mr Shirahama had a very good record and this was his first breach of this rule.  He submitted Mr Shirahama's carelessness was not overly high although two horses received checks.

Mr Shirahama said he had commitments up to and including 5 October.

Reasons for Penalty:

The committee carefully considered all evidence and submissions.  In Mr Shirahama's favour are his admission of the breach and his excellent record.  The aggravating factor was that he kept riding forward with the whip while shifting into the line of two horses on his inside without taking any corrective action.  However the committee finds his carelessness to be at the low end.
