Following Race 8 an information was filed pursuant to Rule 871(1)(d) when it was alleged by Mr George that Mr G McKeon, rider of VALPOLICELLA, allowed his mount to shift ground outwards when not clear

DECISION & REASON:
--Following Race 8 an information was filed pursuant to Rule 871(1)(d) when it was alleged by Mr George that Mr G McKeon, rider of VALPOLICELLA, allowed his mount to shift ground outwards when not clear, forcing KHEPRI (D Walsh) out in to the line of SING SONG GIRL (P Ferris) who, as a result, clipped heels and blundered. This incident occurred near the 350 metre mark.
----Mr McKeon pleaded guilty to the charge.
----Mr George demonstrated the video films and showed where at the 350 metre mark Mr McKeon angled his mount outwards for a run and in doing so took the line of KHEPRI who was forced out into the line of SING SONG GIRL who stumbled and nearly fell. Mr McKeon was not the required distance clear when moving out.
----Mr McKeon said, in his submissions, that he initially brushed Mr Walsh who was on his outside but conceded that that it turned in to be more of a bump. He believed that Mr Ferris was unlucky to be where he was when the incident occurred.
----PENALTY
--In giving Mr McKeon's record Mr George said that he rode extensively and had only two suspensions in the last 12 months, a record that he regarded as very good. He did, however, consider that a suspension was an appropriate penalty. He reminded the committee that this was a listed race and accordingly asked for a penalty of 4-6 days plus a fine of $500-$1000. He confirmed that Mr McKeon had accepted that he had crossed the fine line between competitive and careless riding. He also said that Mr McKeon had engagements at Hastings on 6 October and he didn?t expect any suspension to start till after that day.
----Mr McKeon confirmed his riding engagements on 6 October.
----In coming to its decision the committee has taken into account the provisions of Rule 1122 which deals with the status of the race. It also considered Mr McKeon's good riding record, and the level of seriousness of the offence.

After due consideration we suspend Mr McKeon from the completion of racing on 6 October till the completion of racing on 12 October 2007. (4 days) We also impose a fine of $750.
