The Committee granted Miss McCall a deferment to her suspension pursuant to Rule 1106(2).
Accordingly, her Licence to ride in races is suspended for a period of 4 days commencing after racing on 7 June 2021 and concluding after racing on 13 June 2021. In addition, we impose a $250 fine.
Facts:
This charge arises from the running of Race 6, the Celebrating Te Akau’s Black Type Winners at Ellerslie 1100. Senior Stipendiary Steward, Mr Williamson filed an Information pursuant to Rule 638(1)(d) alleging the rider of “SPEEDY MEADY (E McCall), allowed her mount to shift out at the 100 metres when not the required distance clear of POP STAR PRINCESS which was checked losing ground”.
Miss McCall was supported at the hearing by her employer Ms P Gerard. Miss McCall acknowledged she understood the Rule and confirmed her admission of the breach.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Using the available Race films Senior Stipendiary Steward, Mr Williamson demonstrated the incident and identified the horses and Riders concerned; namely SPEEDY MEADY (E McCall), POP STAR PRINCESS (J Riddell), and IHU (Y Kamagai).
Mr Williamson told the Committee that approaching the 100-metre mark Miss McCall permitted her mount to shift out into the running line of POP STAR PRINCESS who was crowded and checked. He said that SPEEDY MEADY tended to lay out when put under pressure and it shifted ground when struck once with the whip by Miss McCall. Mr Williamson added that because of the incident POP STAR PRINCESS was forced across the heels of IHU who was racing in front of that runner. He concluded that at the time of the shift SPEEDY MEADY was never any more than one length clear of POP STAR PRINCESS.
In response Miss McCall stated that her mount was hanging out and was a difficult ride. She said she applied her whip once to take corrective action.
Ms Gerard said that Miss McCall did her best to manage a difficult ride. She said SPEEDY MEADY over-reacted when struck with the whip.
Submissions for Penalty:
Miss Algar produced Miss McCall’s riding record which indicated one previous breach under the Careless Riding Rule in the last 12 months. This occurred on 17 April 2021 and resulted in a 4-day suspension and $250 fine.
Miss Algar said that the breach was low range. She said a mitigating factor was that SPEEDY MEADY was a difficult ride for Miss McCall due to its racing manners.
Miss McCall sought a 9-day deferment to any proposed suspension until after racing on 7 June 2021. In her submission she asked the Committee to consider her good riding record and her admission of the breach.
Reasons for Penalty:
After considering the submissions and reviewing the race film, the Committee determined Miss McCall’s carelessness to be in the low-range and adopted a 4-day (suspension) and $250 (fine) as the starting point. This conforms with the NZTR Penalty Guide which recommends a 4 day/$250 fine as the starting point for low-range carelessness.
The available films clearly established that Miss McCall shifted out and checked POP STAR PRINCESS. At the time both horses were racing near the rear of the field and the incident occurred near the 100-metre mark.
Miss McCall has a good record, but this is her second breach of the Rule within six weeks from limited race riding opportunities.
After considering Miss McCall’s admission of breach and the above factors the Committee deemed that an appropriate suspension was 4 (national) days and $250 fine.
