CHARGES:

Following race 9 an Information was filed pursuant to rule 638 (1d).  The informant Mr Williamson alleged that Miss M Vance permitted her mount RING OF DESTINY to shift outwards into the line of ROMAN RULER (N Collett) which had to be checked.  This occurred near the 250 metres.

FACTS:

--

Mr Oatham demonstrated the video films and pointed out to the Committee RING OF DESTINY, ridden by Miss Vance, racing in a 5 wide position approaching the 250 metre mark. It was then clearly evident that Miss Vance allowed her mount to shift out approximately 3 horse widths when riding her mount hard with the whip.  This outward movement resulted in her moving into the line of ROMAN RULER (N Collett) who had to be checked off the heels of RING OF DESTINY.  Mr Oatham said Miss Vance was only a bare length clear of ROMAN RULER when she moved into that horse’s line.

SUBMISSION(s):

Miss Vance said in her defence her outward movement was not intentional and she straightened her mount as soon as she heard Miss Collett call out.  However she admitted by then it was too late.

SUBMISSION(s) ON PENALTY:

Mr Williamson said this was Miss Vance’s 4th charge in the last 12 months.  He said that although Miss Vance had straightened her mount her effort was too late.  However he submitted a suspension was appropriate but should be at the low end.

Miss Vance when asked said she would prefer a fine instead of a suspension as she would have trouble in keeping her weight down if suspended.  She told the Committee she had commitments up to and including 2 June 2010.

REASON(s):

--

The Committee carefully considered all evidence and submissions before imposing an appropriate penalty.  The only mitigating factor is Miss Vance’s early admission of guilt.  However this has to be balanced against the breach itself which resulted in the check to ROMAN RULER.  The Committee believes Miss Vance’s carelessness was at the low end and she did make an effort to straighten her mount, albeit too late.  Another aggravating factor is Miss Vance’s record with this being her 4th charge in the last 12 months.

PENALTY:

After taking all the above factors into account we impose a suspension on Miss Vance from riding in races which is to start after the conclusion of racing on 2 June 2010 and conclude after racing after racing on 7 June 2010 (4 days).
