Following race 8 an Information was filed pursuant to rule 638(3b).  The Informant Mr WILLIAMSON alleged that Miss Collett used the whip excessively on her mount PROPOGATE.

FACTS:

--

Mr Oatham demonstrated the video films which clearly showed Miss Collett striking her mount approximately 13 times between the 500 metres and 200 metres. Mr Oatham said Miss Collett did give her mount some respite but this was for only 3 strides and not the necessary 6 under the guidelines.

Miss Collett did not wish to make any submissions when asked.

SUBMISSION(s) ON PENALTY:

Mr Williamson said Miss Collett had incurred one previous whip charge on 28 April, 2010 when she was fined $200.  He submitted this was a similar offence and said a $200 - $300 fine would be appropriate.

Miss Collett had nothing to say regarding penalty.

REASON(s):

--

The Committee considered all evidence and submissions before imposing an appropriate penalty.  This includes Miss Collett’s early admission of the breach and her record.  While it was clear that Miss Collett’s whip actions were excessive the Committee finds her carelessness was at the lower end.  However because this is her second charge in the last 2 months the Committee believes an increase in the penalty she incurred in April is warranted.

We accordingly impose a fine of $250.
