As Mr Yanagida admitted the breach the Committee found the charge proved.

Accordingly, Mr Yanagida’s license to ride in races is suspended for a period to commence after racing on 13 March 2020 and conclude after racing on 27 March 2020.
Facts:
Following the running of race 2, Headquarters Viaduct & The Lonely-Hearts Club Nathans Memorial, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Oatham, alleged that Mr Yanagida angled his mount VOLER POUR MOI out when not sufficiently clear of DANCE CARD making solid contact with that runner which was hampered and unbalanced near the 300 metres.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Yanagida said that he understood the Rule and confirmed he admitted the breach.
Mr Harris supported Mr Yanagida at the hearing.
Mr Coles demonstrated the incident using the available video footage. He identified that Mr Yanagida angled his mount out near the 300 metres when not sufficiently clear of DANCE CARD. He said there was no run available when Mr Yanagida angled his mount outwards and as a consequence VOLER POUR MOI made firm contact with DANCE CARD. He added that DANCE CARD was taken off its running line.
Mr Yanagida said that he tried to get into a gap on the inside of DANCE CARD and FINAL SUGGESTION shifted out slightly which exaggerated the incident.
Mr Harris said that Mr Yanagida was riding in a competitive manner and he needed to exercise more patience. He noted that Mr Innes, the rider of DANCE CARD, was not going to give Mr Yanagida any racing room.
Submissions for Penalty:
Mr Oatham said that Mr Yanagida had 2 previous breaches under this Rule in the last 12 months, the most recent being on 27 February which resulted in an 8-day suspension. He said Mr Yanagida’s record was a neutral factor. He described the level of carelessness as mid-range and to Mr Yanagida’s credit he admitted the breach.
Mr Yanagida and Mr Harris had no submissions on penalty.
Reasons for Penalty:
The Committee considered all the evidence and submissions presented.
When reviewing the video films, the Committee deemed the level of carelessness displayed by Mr Yanagida was mid-range. It was clear that Mr Yanagida directed VOLER POUR MOI outwards near the 300 metres when racing on level terms with DANCE CARD. Mr Yanagida forced a run to the inside of DANCE CARD when there was no run available. Mr Yanagida continued to ride his mount forward and as a result made firm contact with DANCE CARD. In the circumstances Mr Innes, the rider of DANCE CARD, was entitled to hold his line.
The JCA Penalty Guide starting point for mid-range carelessness is 8 national riding days which was adopted.
The mitigating factor was Mr Yanagida’s admission of the breach. For this he was afforded a 1-day reduction in penalty.
We deemed Mr Yanagida’s record over the last 12 months to be a neutral factor. However, we were concerned that this was his 2nd breach this week.
In assessing the quantum of penalty, we were mindful that Mr Yanagida incurred a suspension of 8 days on 27 February 2020 which commences after racing today. Therefore, we took into account the totality effect of that suspension as well as the penalty arising out of this charge.
After taking into account all the above factors the Committee considered that an appropriate suspension was 7 national riding days.
