This is a protest by trainer Mr JA Gibbs following Race 7 alleging that VIZ VITAE (L Innes) or its rider, placed second by the judge, interfered with the chances of BETTER BOY (B Lammas) at the final bend.

Stipendiary Steward Mr AR Coles reserved the right to charge. The official margin between the runners was a nose and one length at the finish. The connections of each horse were represented by their trainers.

Stipendiary Steward Mr J Oatham demonstrated the incident on video and after identifying the runners Mr Gibbs was asked to confirm details of the protest. He explained and demonstrated on video that there had been an inward movement initially by Mr Innes onto Mr Harris riding ARREVIDERCI at the 700 metre mark as the horses were improving for the run home in the straight. That movement had in turn forced Mr Harris onto Mr Lammas causing his mount to clip heels with ULURU (G McKeon) thereby stopping the momentum of BETTER BOY at a crucial part of the race. Although it finished on to be a nose and a length from VIZ VITAE it would have lost more than this from the incident he suggested.

Mr Lammas confirmed that Mr Harris had been forced on to him causing him to clip heels with ULURU.

Mr Innes suggested the videos did not confirm Mr Lammas' evidence and he had in fact come out on BETTER BOY when not clear of ULURU and Mr Harris on ARREVIDERCI had not contributed to the incident as alleged. Mr Baker also felt the video did not support Mr Lammas.

The committee considered all the evidence and reviewed the videos. It was satisfied that the inward movement of VIZ VITAE on to ARREVIDERCI has been established but was not satisfied that this in turn had forced ARREVIDERCI on to BETTER BOY. In view of the inconclusive nature of the evidence of Mr Lammas and Mr Gibbs, which is not supported by the video, the committee found it was insufficient to establish the cause of any loss of chances by BETTER BOY. In fact BETTER BOY may have contributed to the incident and on that basis the protest is dismissed and the judge's placings stand.
