DECISION AND REASON
--Information 5216 alleged a breach of Rule 530(2)(b) by Ms L Woods in that she used the whip in an excessive manner on MONTEZUMA. The breach was admitted.
--The incident was demonstrated on video by Stipendiary Steward Mr J Oatham, who showed Ms Woods using the whip from the turn into the straight without any break in the action as required by the guidelines until the 200 metre mark apart from an occasional pause.
--Ms Woods confirmed that she realised her action was in breach of the rule and knew the guideline requirements. It was in the heat of the moment, she explained, because she was desperate for a good run.
--Mr Coles confirmed this was the first time she had been charged with a breach of this rule but she had previously been warned at Avondale. While she was entitled to credit for admitting the breach and it was the first time in her seven years riding experience he believed a suspension ought to be imposed.
--The committee taking these matters into account, ordered that a three-day suspension be imposed from the conclusion of racing on 1st January 2006 until after racing on 4th January 2006, the meetings involved being Tauherenikau, Tauranga and Whangarei
