As Mr Prastiyou admitted the breach the Committee found the charge proved.

Penalty:

Accordingly, Mr Prastiyou had his license to ride in races suspended for a period to commence after racing on 28 October and conclude after racing on 7 November 2017 (5 days).

That period of suspension encompasses meetings at

1 November – Avondale

3 November – New Plymouth

4 November – Tauranga / Palmerston North

5 November – Banks Peninsula

7 November – Ellerslie – Premier 1

 

Facts:

Following the running of race 8, Love & Co 1400, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Williamson, alleged that Mr Prastiyou allowed his mount BOJANGLES to shift in when not sufficiently clear of WARSET which was checked near the 1200 metres.

Mr Prastiyou acknowledged that he understood the Rule and confirmed his admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Coles used the available video footage to demonstrate the incident. He identified that near the 1200 metres Mr Prastiyou allowed his mount to shift in when only a bare length clear of WARSET. He said this resulted in Ms Collett having to take a hold of WARSET when her mount received a sharp check.

Mr Prastiyou said the incident was clear to see on the video footage. He added that his mount was over racing when the pace eased in the race.

Submissions for Penalty:

Mr Williamson produced Mr Prastiyou’s record which showed 2 previous breaches under this Rule in the last 12 months, the most recent being 31 May. He said Mr Prastiyou shifted inwards in an abrupt manner which resulted in WARSET receiving a decent check. He said the level of carelessness was in the mid to high range.

Mr Prastiyou advised the Committee that any proposed suspension could start immediately. He said that he has been riding all over the country in recent months.

In response to a question from the Committee, Mr Prastiyou conceded that he had no intention of riding at Gore on 2 November. Accordingly, this date was not included in the penalty.

The Stipendiary Stewards were able to provide evidence which confirmed that Mr Prastiyou has a recent history of riding in the South Island.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented. The Penalty Guide for Judicial Committees recommends that the starting point for careless riding is a 5 day suspension.

When reviewing the video footage the Committee observed that Mr Prastiyou allowed his mount to shift into the rightful line of WARSET when only 1 length clear. In doing so Ms Collett, the rider of WARSET, was forced to take a firm hold of her mount when it was crowded and checked. As a result of this incident WARSET lost 1 length and we viewed that WARSET skied it’s head on several occasions when being restrained. We deemed the level of carelessness to be in the mid-range for which a 1 day uplift was applied.

The mitigating factors were Mr Prastiyou’s admission of the breach and his good record. For these collective factors Mr Prastiyou was afforded a reduction of 1 day.

After taking into account all the above factors the Committee considered an appropriate suspension was 5 days.
