Following Race 1 an Information was filed pursuant to Rule 871 (1) (d). The Informant Mr J Oatham alleged that Mr D Hain, rider of Adrama Aday, permitted his mount to shift inwards near the 2000 metres when not sufficiently clear of Guanan Juato (C Lammas) who was checked.

Following Race 1 an Information was filed pursuant to Rule 871 (1) (d). The Informant Mr J Oatham alleged that Mr D Hain, rider of Adrama Aday, permitted his mount to shift inwards near the 2000 metres when not sufficiently clear of Guanan Juato (C Lammas) who was checked.
--Mr Hain admitted the breach.
--Mr Coles demonstrated the video films which clearly showed movement in from Mr Hain at the 2000 metres which resulted in tightening to Guanan Juato forcing his rider to check. Mr Hain was not the required distance clear when moving in.

PENALTY SUBMISSIONS
Mr J Oatham submitted that this was at the lower end of carelessness and although Mr Hain did not move in very much he did not make enough effort in allowing room for Mr Lammas.
--He submitted a suspension was appropriate.
--Mr Hain had nothing to add other than stating his horse was racing erratically. He had no commitments in the next 7 days.

PENALTY
The Committee considered all submissions and in deliberation took into account Mr Hain’s good record, his guilty plea and the level of carelessness on his part.
--We concur with Mr Oatham this was at the lower end and accordingly impose a suspension to start after racing today (28/3/09) until after racing on 4/4/09 (4 days)
