Decision:

Following Race 1 an Information was filed pursuant to Rule 871 (1) (d).  The Informant Mr J Oatham alleged that Mrs T Thornton angled her mount outwards near the 250 metres when insufficiently clear of ‘Young Zeus”’ (M Sweeney).

Following Race 1 an Information was filed pursuant to Rule 871 (1) (d).  The Informant Mr J Oatham alleged that Mrs T Thornton angled her mount outwards near the 250 metres when insufficiently clear of ‘Young Zeus”’ (M Sweeney).

Mrs Thornton pleaded guilty.

Mr Coles demonstrated the video films which clearly showed Mrs Thornton riding ‘Gembra’, which was racing on the fence near the 250 metres, angle her mount out into a gap but in doing so take the line of ‘Young Zeus’ (M Sweeney) who had to check his mount.  Mr Coles said Mrs Thornton was only a bare length clear of Mr Sweeney and not the required distance clear.  He considered it was an error of judgement on Mrs Thornton’s part.

Mrs Thornton accepted Mr Coles’ interpretation of the incident.

PENALTY SUBMISSIONS

Mr J Oatham said Mrs Thornton had an excellent record with no charges in the last 12 months.  He considered the interference was midrange but believed a suspension was warranted at the lower end.

PENALTY

--

The Committee considered all submissions and before imposing a penalty took into account the following:

--

Mrs Thornton’s outstanding record
Her guilty plea
Her level of carelessness which we believe is at the lower end.

--

Accordingly we impose a suspension to start after racing today 28/3/09 and conclude after racing on 4/4/09 (4 days).
