Accordingly for the reasons above we find the charge proved.

Penalty:

Accordingly we impose a suspension on Mr Calder from riding in races which is to start after racing on 3 January and conclude after racing on 13 January 2011 (5 days).

Facts:

Mr George demonstrated the video films where he alleged that Mr Calder, rider of WORTHING, was guilty of careless riding in the home straight.  He said that Mr Calder failed to stop riding when his mount was shifting out and insufficiently clear of NOBLE WARRIOR who was impeded. 

Submissions for Decision:

Mr George stated that it was Mr Calder's obligation to stop riding and correct his mount but on this occasion he had continued to push out when only marginally or not clear of NOBLE WARRIOR.

Mr Calder, while he admitted moving out 5 -6 horse widths, said he was always clear of NOBLE WARRIOR.  He said Mr Parish did not have to stop riding or pull his mount off. 

Reasons for Decision:

The committee carefully considered the evidence and submissions and reviewed the video films.  We find Mr Calder guilty as charged because it was evident that he was only 1 1/2 lengths clear of NOBLE WARRIOR on more than 1 occasion when continuing to move out.  It was clear that Mr Parish could not have maintained the line he was on and entitled to without moving out to avoid clipping heels.  This was because Mr Calder moved into his line when not sufficiently clear.  The films showed that Mr Calder moved out 6 mower strips and continued to ride forward the whole time making no attempt to straighten his mount. 

Submissions for Penalty:

Mr George produced Mr Calder's record which showed 3 suspensions in the last 12 months.  He submitted that on this occasion Mr Calder's actions were at the mid range of carelessness as he failed in his obligation to correct his mount.

Mr Calder told the committee he had commitments up to and including January 3 and did not intend riding in the South Island in the near future.

Reasons for Penalty:

The committee considered all submissions before imposing an appropriate penalty.  Mr Calder's record is a good one for the number of rides he has and his honesty in regard to the South Island race days was appreciated by the committee.  However the aggravating factor in this charge is that Mr Calder continued to ride out for a considerable distance without taking corrective action.  The committee is satisfied that he was not the required distance clear when doing so.  Taking all these factors into account we determine a 5 day suspension is appropriate.
