Following Race 10 an information was laid by Stipendiary Steward Mr J Oatham against jockey Mr T J Russell alleging a breach of Rule 871 (1) (d), namely careless riding. Information # 6616 reads : "T Russell allowed his mount KEYNASSUE, number 3, to shift in dictating FORCEFUL, number 10, and LIONSTAR, number 7, inwards causing a check to MY PRIZED BIRD, number 13, ridden by K Herrock".
--Mr T J Russell admits the breach.
--Stipendiary Steward Mr A Coles demonstrated the incident on the race videos (head on). Mr Coles' interpretation was, in summary, at approximately the 200 metres mark Mr Russell, rider of KEYNASSUE, number 3, permitted his mount to shift inwards dictating FORCEFUL, number 10, ridden by Jason Waddell, inwards on to LIONSTAR, number 7, ridden by Patrick Ferris, who was dictated into the line of MY PRIZE BIRD, number 13, ridden by Kate Herrock, which was checked.
--Mr T Russell accepted Mr A Coles' interpretation of the incident and said it was fair and accurate.
--The only issue for consideration is penalty.
--Stipendiary Steward Mr Oatham sought a suspension in this matter; he said Mr T J Russell had a good riding record and reminded us that MY PRIZED BIRD, ridden by K Herrock, received a sharp check. Mr Russell candidly acknowledged his riding was careless and that he made an error of judgement.
--PENALTY :
--We have taken into account the following :
--- --
- Gulty plea / admission of the charge. --
- Your good riding record (last suspension approximately 8 months ago) --
- All submissions on penalty by Mr Oatham and Mr T J Russell --
- Your explanation, and the visual evidence --
- The degree of carelessness and the fact two horses were tightened and a third horse (MY PRIZED BIRD) suffered a check.
We have determined that a suspension must be imposed.
--Your jockey's licence is suspended from the conclusion of racing on Wednesday 31 October 2007 up to the conclusion of racing on Saturday 03 November 2007 (3 riding days).
