Decision:

Following Race 1 a protest was lodged by Mr L Innes pursuant to Rule 876(1) when it was alleged that FALRAIN or its rider placed 1st by the Judge interfered with the chances of EBONY BABE placed 2nd by the Judge.



Following Race 1 a protest was lodged by Mr L Innes pursuant to Rule 876(1) when it was alleged that FALRAIN or its rider placed 1st by the Judge interfered with the chances of EBONY BABE placed 2nd by the Judge.

The interference occurred in the final 200 metres.

--

The Judges margin between first and second was a nose.

--

Present were Mr L Innes and Mr R Otto representing EBONY BABE

Mr B Wallace and Mr A Peard represented FALRAIN.

--

The informant Mr L Innes, demonstrsted the video films and showed where, in the final 150 metres FALRAIN coming from two horse widths off the running rail to 5-6 widths, and in doing so push EBONY BABE out three horse widths. He said that, in his opinion, this movement cost him at least half a length.

Mr Otto had nothing to add.

Mr B Wallace, the trainer of FALRAIN, said that both horses came from the back of the field with his horse initially getting pushed in. From then both horses had a clear run to the line with Mr Innes never having to stop riding his mount.

Mr Peard had nothing to add.

--

Chief Stipendary Steward Mr George, when asked for his assessment of the protest, said that FALRAIN came from three off the fence and dictated the line of EBONY BABE. In his opinion this was enough to affect the placings.

The committee carefully considered the evidence and reviewed the video. It was clear, in our view, that EBONY BABE did suffer interference in the last 150 metres of the race when its line was dictated out by FALRAIN.

--

Having ruled that interference has taken place we must then decide whether, in our opinion, this interference has affected the chances of EBONY BABE finishing in a better place, taking into account the margin between first and second was a nose.

--

There is no doubt, in our minds, that EBONY BABE did suffer a lost opportunity to finish in a better position when it’s line was dictated out over the final 150 metres and being beaten by only a nose.

--

The protest is upheld and the placings are:
