Facts:
Following the running of Race 4, Karaka Million 3 YO Classic (Listed Race), an Information was filed Instigating a Protest pursuant to Rule 642(1). The Informant, Mr Bell, alleged that EVER LOYAL or its rider placed 3rd by the Judge interfered with the chances of KAPOOR placed 5th by the Judge.
The interference was alleged to have occurred in the final straight.
The Judge's placing were as follows:
1st - No. 5 SCOTT BASE
2nd - No. 1 EMBELLISH
3rd - No. 2 EVER LOYAL
4th - No. 12 SAVVY COUP
5th - No. 14 KAPOOR
The official margins were a long neck, 2 ½ lengths, nose and ½ a head
Rule 642(1) states: “If a placed horse or its rider causes interference within the meaning of this rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with”.
All connections present acknowledged they understood the Rule.

Mr Bell said that EVER LOYAL shifted out over the final 50 metres and this interfered with the chances of KAPOOR. He said the interference put KAPOOR off balance and this cost his horse the opportunity to finish in 3rd place.
Ms Johnson said that the initial interference occurred when SCOTT BASE laid in onto SAVVY COUP which in turn hampered KAPOOR. She said over the final 50 metres EVER LOYAL “shunted” KAPOOR outwards.
Mr Pike said that SCOTT BASE laid in near the 100 metres and interfered with SAVVY COUP which impeded KAPOOR. He said the alleged interference against EVER LOYAL happened close to the finish line. He added that Ms Johnson never stopped riding KAPOOR.
Mr Innes said the initial interference happened when SCOTT BASE laid in. He said that in the final 50 metres Ms Johnson never stopped riding KAPOOR.
Mr Oatham submitted that EVER LOYAL shifted out over the final 50 metres when under a hard ride and that runner impeded with KAPOOR’s progress. He said given the margins at the finish the protest did have some merit.
Reasons for Decision:
The Committee carefully considered all of the submissions presented and reviewed the video films several times.
It was noticeable that over the final 50 metres EVER LOYAL was under a hard ride when being ridden with the whip. It was obvious that EVER LOYAL shifted out several horse widths and this forced KAPOOR out over extra ground at a vital stage in the race. The Committee observed that KAPOOR was taking visible ground off EVER LOYAL inside the final 50 metres despite being interfered with.
After considering the degree of interference and the very narrow margins of a nose and ½ a head the Committee was of the opinion that KAPOOR would have finished ahead of EVER LOYAL had such interference not occurred.
