As the breach was admitted we find the charge proved.
Penalty:
Therefore we suspend Mr McDonald’s race riding license from after the conclusion of racing on 2 February until after racing concludes on 9 February 2013 (5 days).

Facts:
Following race 6 the Informant Mr J Oatham filed an Information pursuant to rule 638(1) (c). He alleged that in passing the 350 metres Mr J McDonald permitted his mount ATACAMA to move out when not clear of TAKE CHARGE which was checked. Also affected in this incident was OTTO THE GREAT.
Submissions for Decision:
Mr Neil demonstrated the relevant video films which showed ATACAMA, the eventual winner, looking for a run with approximately 350 metres to go. Mr Neil pointed out on the films Mr McDonald angle out to gain that run but in doing so moved into the line of TAKE CHARGE when insufficiently clear. This caused TAKE CHARGE to be checked with the result also affecting OTTO THE GREAT.
Mr McDonald submitted that the horse he was following was going forward and half a gap presented itself. He said he moved out to get off heels but admitted he had gone one stride too far. He added that ATACAMA had only had 3 starts, was still green and over reacted in the tight quarters.
Submissions for Penalty:
Mr Oatham stated that Mr McDonald had incurred 2 suspensions in New Zealand in the last 12 months but had been riding overseas for a large part of that time. He submitted that today’s breach was in the mid range.
Mr McDonald said he had commitments up to and including 2 February.
Reasons for Penalty:
The committee considered all evidence and submissions. To Mr McDonald’s credit he has admitted the breach and his record in New Zealand is a good one. However he angled out with little regard for the runners on his outside when insufficiently clear. The committee independently assesses the breach to be mid range.
As Mr McDonald is now riding in Australia the committee adopted the JCA policy of treating him as a New Zealand wide rider, this being the policy for all overseas riders.
Accordingly after taking all the above into account we find the appropriate penalty to be one of 5 days.
