As the breach was admitted we find the charge proved.
Penalty:
Accordingly after taking all the above into account and adopting the standard starting point of 5 days the committee determines an appropriate penalty to be one of 4 days. This gives credit to Mr Hutton for the mitigating factors outlined. The committee is mindful that Mr Hutton will be serving a suspension until the conclusion of racing on 10 February. Therefore we order this suspension to start after racing on 10 February and conclude after racing on 16 February 2013 (4 days).

Facts:
Following race 4 the Informant Mr J Oatham filed an Information pursuant to rule 638(1) (c). He alleged that passing the 900 metres Mr Hutton permitted his mount RATTLE AND HUM to shift in when not clear of HOT IN PINK. As a result she was taken inwards into the line of LITTLE WONDER which was checked.
Submissions for Decision:
Mr Williamson demonstrated the relevant video films which showed Mr Hutton allowing his mount RATTLE AND HUM to move in soon after the 900 metres. Mr Williamson submitted that Mr Hutton was approximately 3/4 length clear of HOT IN PINK when moving in. This resulted in LITTLE WONDER’S line being taken causing her to be checked.
Mr Hutton in admitting the breach said his horse was racing erratically and was tending to lean over horses on his inside. However he admitted he did not do enough to correct his mount and he was at fault.

Mr Oatham said it was unfortunate that Mr Hutton had committed 2 breaches in the same race and asked the committee to take into account his inexperience. He submitted this was only his 2nd charge in 26 rides and said because of the unusual circumstances a 3 day suspension may be appropriate.
Mr Hutton said he had commitments until after racing on 2 February and confirmed he only rode in the North Island.

The committee carefully considered all evidence and submissions. Mitigating factors are Mr Hutton’s inexperience, he has admitted the breach and prior to today he had not incurred any charges. However the aggravating factor is that LITTLE WONDER received quite a bad check through Mr Hutton moving in when insufficiently clear. The committee independently assesses Mr Hutton’s breach to be at the low end of carelessness.
