As the breach was admitted we find the charge proved.
Penalty:
Accordingly, taking all the above into account and giving Mr Hutton credit for the mitigating factors we find an appropriate suspension to be one of 4 days. Therefore Mr Hutton is suspended from riding in races from after racing on 2 February and until after racing on 10 February 2013 (4 days).

Facts:
Following race 4 the Informant Mr J Oatham filed an Information pursuant to rule 638(1) (c). He alleged that in passing the 1100 metres Mr Hutton angled his mount RATTLE AND HUM inward crowding TOLARNO onto SEDGWICK which in turn shifted in tightening and checking SHE’S SMASHING.
Submissions for Decision:
Mr Williamson demonstrated the relevant video films which showed RATTLE AND HUM racing in a position 2 from the outside passing the 1100 metres. He pointed out Mr Hutton allowing his mount to shift in when insufficiently clear crowding TOLARNO who was forced in onto SHE’S SMASHING who lost her rightful line of running.
Mr Hutton in admitting the breach said Mr Du Plessis and Mr Colgan were both moving about making some contribution to the incident.
Mr Forsman said Mr Hutton had explained everything well and he had nothing to add.

Mr Oatham told the committee that Mr Hutton had had only 26 rides for 2 wins so was still inexperienced. He added this was his first charge and RATTLE AND HUM was not the easiest horse to ride. Mr Oatham said it was unfortunate that Mr Hutton was being charged for 2 cases of interference in the same race but several horses were affected through his carelessness. He submitted a suspension of 3 days for each breach may be appropriate.
Mr Hutton said he did have commitments until the conclusion of racing on 2 February and confirmed he only rode in the North Island.
