Facts:
Prior to race 3 the Informant, Mr J Oatham filed an Information pursuant to rule 330 (3) (c). He alleged Mr Bosson was unable to make the required weights for TWILIGHT GRANITA in race 3 and COSTUME in race 6.
Submissions for Decision:
Mr Oatham explained to the committee that Mr Bosson was engaged to ride 2 horses at 54.5 kgs, but at weighing out was found to be .75 kgs over and was replaced for his rides in races 3 and 6.
Mr Bosson said that for the 2 races in question it was agreed with the connections that he could ride at 55 kgs. He was confident when taking the rides he could make this weight but admitted he was the only one to blame.

Mr Oatham said Mr Bosson and incurred 3 weight charges in the last 12 months. He reminded the committee race 3 was a listed race for $100,000 and in race 6 Mr Bosson was engaged for the hot favourite. He submitted a fine of $300 - $500 dollars would be appropriate.
Reasons for Penalty:
The committee considered all evidence and submissions and voiced its concern to Mr Bosson at the record he was compiling regarding race issues. It is significant today that 2 horses were affected, one being in a $100,000 race and the other being the hot favourite.
The other aggravating factor is that this is Mr Bosson’s 4th charge in 12 months.
